These terms and conditions (hereinafter referred to as "Terms") apply to all products and services purchased through WUN GMBH – BALLONSHOPZUERICH.CH. This includes delivery.
The order becomes binding for the buyer once it has been finalized and submitted. By placing the order, the buyer accepts the terms and conditions.
The buyer's general terms and conditions of purchase are hereby expressly rejected.
The place of jurisdiction is the registered office of WUN GMBH – BALLONSHOPZUERICH.CH, 8005 Zurich. The contract is subject to Swiss law.

2 – Offer
WUN GMBH – BALLONSHOPZUERICH.CH excludes all liability for the products sold and delivered to the extent permitted by law.
All products are not suitable for children under 3 years old.
The services offered by WUN GMBH – BALLONSHOPZUERICH.CH are exclusively for customers residing or having their business address in Switzerland (CHE). Deliveries are made exclusively to addresses in Switzerland and the Principality of Liechtenstein.
All items available for order are either immediately available for delivery or can be picked up after online ordering; stock availability errors are reserved.
The product information on WUN GMBH – BALLONSHOPZUERICH.CH (photos, illustrations, dimensions, weights, etc.) is for guidance only. This information is generally obtained directly from the manufacturers. Therefore, no liability can be assumed for the accuracy, completeness, or timeliness of the product information. WUN GMBH – BALLONSHOPZUERICH.CH makes every effort to provide accurate product information.
Unless otherwise stated, the size specifications for foil balloons correspond to the size when uninflated.

3 – Prices
The prices published on WUN GMBH – BALLONSHOPZUERICH.CH are authoritative. All prices are in Swiss francs (CHF).

4 – Minimum order value
There is no minimum order value. For orders under CHF 15, we charge a small order surcharge of CHF 8.

5 – Delivery
Your order will be carefully packaged. Delivery will be made from our warehouse in Zurich via Swiss Post.
Shipping will take place as soon as possible, but at the latest within 24 hours (on working days).
This applies to weekdays. There is no shipping on Saturdays and Sundays.
All products available for order are ready for immediate delivery or collection. Subject to availability errors.
Dates and delivery times are non-binding unless expressly agreed otherwise in writing. Any indication of specific delivery times and dates by WUN GMBH – BALLONSHOPZUERICH.CH is subject to correct and timely delivery by suppliers and manufacturers.
WUN GMBH – BALLONSHOPZUERICH.CH is entitled to make partial deliveries.

6 – Shipping and collection costs
Shipping and any applicable collection costs are listed in the order.
For pickups between 09:00 and 10:00 AM and between 20:00 and 22:00 PM, as well as for pickups on Sundays, we charge an additional pickup fee of CHF 5. This surcharge is displayed when selecting the time slot during the ordering process.

7 – Transfer of Risk
Delivery is at the recipient's risk.
The goods must be checked immediately upon arrival for accuracy, completeness, and integrity. Any transport damage must be reported and documented immediately, and no later than two calendar days after receipt of the goods.
The risk passes to the buyer as soon as the shipment has been handed over to the person carrying out the transport. If the shipment is delayed or becomes impossible through no fault of WUN GMBH – BALLONSHOPZUERICH.CH, the risk passes to the buyer upon notification of readiness for shipment.
Visible discrepancies in quantity must be reported to the carrier in writing immediately upon receipt of the goods. Concealed discrepancies in quantity must be reported to WUN GMBH – BALLONSHOPZUERICH.CH immediately upon receipt of the shipment. Any other complaints must also be reported immediately.

8 – Payment Terms
When paying with Twint, PostFinance Card or credit card, the amount is debited upon ordering.
In the case of advance payment or bank transfer, delivery will only take place after receipt of payment.
When selecting “Payment upon collection”, WUN GMBH – BALLONSHOPZUERICH.CH reserves the right to fill ordered helium balloons only when the customer is present on site. Any waiting time in this case should be expected by the customer.
A payment is only considered complete when WUN GMBH – BALLONSHOPZUERICH.CH has access to the funds.

9 – Retention of title
The delivered goods remain the property of WUN GMBH – BALLONSHOPZUERICH.CH until full payment has been received.
In the event of late payment, WUN GMBH – BALLONSHOPZUERICH.CH is entitled to charge, in addition to reminder fees, a standard bank default interest rate.
During the period of delay, WUN GMBH – BALLONSHOPZUERICH.CH is also entitled at any time to withdraw from the contract, demand the return of the delivered goods and claim damages for the cancellation of the contract.
All claims become due immediately if the customer defaults on payment, culpably fails to comply with other essential obligations under the contract, or if WUN GMBH – BALLONSHOPZUERICH.CH becomes aware of circumstances that are likely to impair the customer's creditworthiness, in particular cessation of payments, pendency of composition or bankruptcy proceedings.
In these cases, WUN GMBH – BALLONSHOPZUERICH.CH is entitled to withhold any outstanding deliveries or to execute them only against prepayment or security.
WUN GMBH – BALLONSHOPZUERICH.CH reserves the right to request prepayment or payment by credit card.
Claims for damages arising from impossibility of performance, breach of contract, negligence in the formation of the contract and tort are excluded against both WUN GMBH – BALLONSHOPZUERICH.CH and our vicarious agents, unless there is intentional or grossly negligent conduct.
Any liability for consequential damages arising from the use of the products is excluded.

10 – Return
Returns of items from WUN GMBH – BALLONSHOPZUERICH.CH are generally not possible.
For returns of defective products, WUN GMBH – BALLONSHOPZUERICH.CH requires that the defective product, with a complete and detailed description of the defect/fault, be returned to WUN GMBH – BALLONSHOPZUERICH.CH, Heinrichstrasse 225, 8005 Zurich, within a maximum of 3-4 days.
Returns or exchanges must be accompanied by a copy of the invoice or delivery note.
Products that we procure at the customer's request are excluded from return.
Return postage costs are not covered by WUN GMBH – BALLONSHOPZUERICH.CH.

11 – Liability
WUN GMBH – BALLONSHOPZUERICH.CH excludes all liability for the products sold and delivered to the extent permitted by law.
WUN GMBH – BALLONSHOPZUERICH.CH assumes no liability for the timeliness, accuracy and completeness of the information provided in the online shop.
Liability claims against WUN GMBH – BALLONSHOPZUERICH.CH relating to material or immaterial damages caused by the use or non-use of the information and products provided, or by the use of incorrect or incomplete information and products, are generally excluded.

13 – Data Protection & Storage

No permanent customer accounts are created. Orders are placed exclusively as a guest. The data entered by the customer is used only for processing the order, delivery, and invoicing.
Due to legal regulations (Art. 958f OR), WUN GMBH – BALLONSHOPZUERICH.CH is obligated to retain business records and accounting documents (including invoices, order confirmations, and the transaction data contained therein) for at least 10 years.
